Konceptet er at jeg i min virksomhed skal sælge gaveæsker. Det går ud på, at man kan gå ind på min virksomheds webshop og vælge samt betale for en gaveæske som man gerne vil forære til en bekendt. Min virksomhed sørger så for forsendelse af gaveæsken til modtager.

Lad mig for overskuelighedens skyld sætte et scenarie op:

1. “Martin” vil gerne overraske sin ven, “Jeppe”, med en gaveæske (indeholdende 1 stk. slips og 1 stk. butterfly)

2. Martin udvælger på webshoppen den gaveæske han vil give til sin ven, Jeppe.

3. Martin angiver oplysninger som er relevante for forsendelsen. Dvs. alle eller blot nogle af følgende, alt efter hvad, der er tilladt: Jeppes telefonnummer, Jeppes emailadresse, Jeppes fysiske adresse.

4. Martin betaler for gaveæsken og jeg (min virksomhed) sender gaveæsken til Jeppe vha. de oplysninger, Martin har angivet ifm. bestilling inde på webshoppen.

Er dette lovligt? Altså det faktum at Martin angiver en anden persons kontakt/adresseoplysninger, som jeg så som virksomhed tager imod og gør brug af. Altså oplysninger på en person (Jeppe) som ikke selv har været inde og angive noget som helst – og som vel dermed i princippet ikke har givet samtykke til at der bliver gjort brug af hans oplysninger?

Hvilke af de nævnte former for oplysninger, hvis overhovedet nogen af dem, må jeg i ovenstående eksempel gøre brug af – og dermed også fremover i alle andre tilfælde?:

Som hovedregel er sager om ansættelse eller forfremmelse i den offentliges tjeneste undtaget fra aktindsigt. Herunder gælder blandt andet en medarbejders lønforhold, ferieregnskab, sygelister, personalebedømmelser m.v.

I det private må der heller ikke videregives oplysninger om privates forhold, medmindre den pågældende har en retlig interesse. Det kan jeg ud fra dine oplysninger ikke afgøre om er tilfældet.

4. Hej, Jeg er i den situation, at min udlejer påstår, at min kæreste, Mads, bor hos mig – hvilket han ikke gør. Denne påstand har han efter et besøg, hvor han (udlejer), Lasse, personligt ville se på problemer med afløb og toilet. Her så Lasse, at nogle af Mads’ toiletsager stod på badeværelset, samt der hang få dele tøj på en knage, som det eneste af Mads’ ting i huset. I garagen påpeger Lasse så, at motorcyklen (Mads’) vel ikke er min, og han spørger til, hvem alt værktøjet tilhører. – Med dette tænker jeg selvfølgelig, at det må være helt op til mig som lejer, at jeg må opbevare hvad jeg vil i min beboelse. Og motorcyklen var jo det eneste transportmiddel på stedet, som Mads kunne eje, idet jeg bor på landet.

Mads har egen bopæl i Aalborg, hvor han studerer til dagligt.

Jeg har i denne mail vedhæftet, hvad min udlejer har skrevet til mig; bl.a. at han hævder, at Mads har bopæl her, og at lejen derfor skal stige til 5000 kr om måneden, fra d. 1/10 2017. Lejen er nu på 4200 kr.

Derudover vil Lasse ophæve min nuværende lejekontrakt, og mener, at jeg skal indgå i en ny, hvilket jeg naturligvis nægter.

Først og fremmest skal det bemærkes, at det fremgår af lejekontraktens § 11, 1. Punkt. at lejemålet alene må benyttes til beboelse af dig, og hvis du skulle have lyst til at dele lejemålet med en anden, skulle dette skriftligt accepteres af udlejer, hvorefter der ville skulle oprettes en ny lejekontrakt. Hvis det heraf lægges til grund, at du har misligholdt denne del af aftalen, har din udlejer retten til at opsige dig, dog ved først at have gjort dig opmærksom på problemet.

Udlejeren kan dog ikke umiddelbart sætte huslejen op, da huslejen fastsættes ift. beliggenhed, størrelse, udstyr, art og vedligeholdelsestilstand.
